When using our Text message or SMS message feature of our apps you are agreeing to hold Appcapable LLC and its members harmless for text messages you send through our app. Sending SMS in a way that violates TCPA and state or local regulations can carry fines. So please be professional, know your customer, and follow the instructions below. We are not attorneys, so we also suggest you research TCPA and local laws to insure SMS is sent in a compliant manner. By using our SMS service you agree to the following points.
- You agree to get permission from your customer prior to sending a text to your customer. We require that you obtain permission as many states and jurisdictions require you obtain permission to send texts to your clients for marketing purposes.
- Your agree to check the Clover Customer Database found on your Clover.com Dashboard to insure that the customer has not opted out of marketing through Clover. If your customer has opted out of marketing through Clovers customer database you agree to not send them SMS via our service.
- You agree to Honor Opt-Outs. Our service allows your customers to Opt-Out by simply texting “STOP” to Opt-Out. However, if a customer asks you verbally or in writing to not to send them SMS or Text, you agree not to use our service to send them SMS or Texts.
- You agree to send SMS or texts during hours of the day that are deemed business hours. Texts should only be sent between the hours 7 am and 7 pm.
- You agree that unless you are a charitable organization that you will not use Texting or SMS to market to your customers. If you are not a charitable organization you agree to only use Appcapable LLC SMS/Texting feature capture payments form your existing customers.
- Your agree to research TCPA rulings and SMS regulations for your state and justification to insure you are using our service in a compliant manner.
